SEC. 346. CONTRACTS TO PERFORM WORKLOADS PREVIOUSLY PERFORMED BY DEPOT-LEVEL ACTIVITIES OF THE DEPARTMENT OF DEFENSE. Section 2469 of title 10, United States Code, is amended— (1) by inserting “(a) Requirement for Competition.—” before “The Secretary of Defense”; (2) by striking out “threshold”; (3) by striking out “unless” and all that follows and inserting in lieu thereof “to performance by a contractor unless the Secretary uses competitive procedures for the selection of the contractor to perform such workload.”; and (4) by adding at the end the following new subsection: “(b) Inapplicability of OMB Circular A-76.—The use of Office of Management and Budget Circular A-76 shall not apply to a performance change under subsection (a).”.
