SEC. 216. DEMONSTRATION PROGRAM FOR BALLISTIC MISSILE POSTLAUNCH DESTRUCT MECHANISM. (a) Demonstration Program.—The Secretary of Defense shall conduct a demonstration program to develop and test a ballistic missile post-launch destruct mechanism. The program shall be carried out through the Advanced Research Projects Agency. 107 STAT. 1588 (b) Funding.—The amount expended for the demonstration program may not exceed $15,000,000. Subject to the provisions of appropriations Acts, the Secretary may provide $5,000,000 for the program from unexpended balances remaining available for obligation from funds appropriated to the Department of Defense for fiscal year 1993. (c) Waiver.—The Secretary of Defense may waive the requirement to conduct a demonstration program under subsection (a) if the Secretary certifies to the congressional defense committees that conducting such a program is not in the national security interest of the United States.
