DETERMINATIONS AND DECISIONS.
SEC. 1553. DETERMINATIONS AND DECISIONS. Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251 et seq.), as amended by section 1552, is further amended by adding at the end the following new section: “SEC. 312. DETERMINATIONS AND DECISIONS. “(a) Individual or Class Determinations and Decisions Authorized.— Determinations and decisions required to be made under this title by the head of an executive agency may be made for an individual purchase or contract or, except to the extent expressly prohibited by another provision of law, for a class of purchases or contracts. Such determinations and decisions are final. “(b) Written Findings Required.— (1) Each determination under section 305(d) or section 304C(c)(2)(B) shall be based on a written finding by the person making the determination or decision. The finding shall set out facts and circumstances that support the determination or decision. “(2) Each finding referred to in paragraph (1) is final. “(3) The head of an executive agency shall maintain for a period of not less than 6 years a copy of each finding referred to in paragraph (1) that is made by a person in that executive agency. The period begins on the date of the determination or decision to which the finding relates.”.
