SEC. 308. DISCHARGE OF OBLIGATIONS IN BANKRUPTCY. (a) In General.—Section 338E(d)(3) (as redesignated by sections 201(2) and 202(e)(3) of this Act) is amended by inserting before the period a comma and “and only if the bankruptcy court finds that nondischarge of the obligation would be unconscionable”. (b) Existing Proceedings.—The amendment made by subsection (a) applies to any bankruptcy proceeding in which discharge of an obligation under section 338E(d)(3) of the Public Health Service Act (as redesignated by sections 201(2) and 202(e)(3) of this Act) has not been granted before the date that is 31 days after the date of enactment of this Act.
