SEC. 412. WAIVER AUTHORITY CONCERNING NOTICE OF DENIAL OF APPLICATION FOR VISAS. Section 212(b) of the Immigration and Nationality Act (8 U.S.C. 1182(b)) is amended— (1) by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting each new subparagraph 2 ems to the right; (2) by striking “If” and inserting “(1) Subject to paragraphs (2) and (3), if”; and (3) by adding at the end the following new paragraphs: “(2) The Secretary of State may waive the requirements of paragraph (1) with respect to a particular alien or any class or classes of excludable aliens. “(3) Paragraph (1) does not apply to any alien excludable under paragraph (2) or (3) of subsection (a).”.
