SEC. 110. DEFINITIONS. Section 113 of the Child Abuse Prevention and Treatment Act (42 U.S.C. 5106h) is amended— (1) by striking paragraphs (1), (2), (5), and (9); (2) (A) by redesignating paragraphs (3), (4), and (6) through (8) as paragraphs (1) through (5), respectively; and (B) by redesignating paragraph (10) as paragraph (6); (3) in paragraph (2) (as redesignated), to read as follows: “(2) the term ‘child abuse and neglect’ means, at a minimum, any recent act or failure to act on the part of a parent or caretaker, which results in death, serious physical or emotional harm, sexual abuse or exploitation, or an act or failure to act which presents an imminent risk of serious harm;”; and (4) in paragraph (4)(B) (as redesignated), by inserting “, and in cases of caretaker or inter-familial relationships, statutory rape” after “rape”.
