Sec. 8114. (a) Limitation.—Of the funds available under title II under the heading “Former Soviet Union Threat Reduction” for dismantlement and destruction of chemical weapons, not more 109 STAT. 675 than $52,000,000 may be obligated or expended for that purpose until the President certifies to Congress the following: (1) That the United States and Russia have completed a joint laboratory study evaluating the proposal of Russia to neutralize its chemical weapons and the United States agrees with the proposal. (2) That Russia is in the process of preparing, with the assistance of the United States as necessary, a comprehensive plan to manage the dismantlement and destruction of the Russia chemical weapons stockpile. (3) That the United States and Russia are committed to resolving outstanding issues under the 1989 Wyoming Memorandum of Understanding and the 1990 Bilateral Destruction Agreement. (b) Definitions.—In this section: (1) The term “1989 Wyoming Memorandum of Understanding” means the Memorandum of Understanding between the Government of the United States of America and the Government of the Union of Soviet Socialist Republics Regarding a Bilateral Verification Experiment and Data Exchange Related to Prohibition on Chemical Weapons, signed at Jackson Hole, Wyoming, on September 23, 1989. (2) The term “1990 Bilateral Destruction Agreement” means the Agreement between the United States of America and the Union of Soviet Socialist Republics on destruction and non-production of chemical weapons and on measures to facilitate the multilateral convention on banning chemical weapons signed on June 1, 1990.
