BACKGROUND CHECK OF LOAN APPLICANTS.
SEC. 231. BACKGROUND CHECK OF LOAN APPLICANTS. Section 7(a) of the Small Business Act (15 U.S.C. 636(a)) is amended— (1) by striking “(a) The Administration” and inserting the following: “(a) Loans to Small Business Concerns; Allowable Purposes; Qualified Business; Restrictions and Limitations.— The Administration”; and (2) in paragraph (1)— (A) by striking “(1) No financial” and inserting the following: “(1) In general.— “(A) Credit elsewhere.— No financial”; and (B) by adding at the end the following: “(B) Background checks.— Prior to the approval of any loan made pursuant to this subsection, or section 503 of the Small Business Investment Act of 1958, the Administrator may verify the applicant’s criminal background, or lack thereof, through the best available means, including, if possible, use of the National Crime Information Center computer system at the Federal Bureau of Investigation.”.
