Sec. 10007. (a) Employment Contract.— Paragraph 2 of section 1 of the Act entitled “An Act relating to the Metropolitan police of the District of Columbia”, approved February 28, 1901 (D.C. Code, sec. 4–104), and any other provision of law affecting the employment of the Chief of the Metropolitan Police Department of the District of Columbia shall not apply to the Chief of the Department to the extent that such paragraph or provision is inconsistent with the terms of an employment agreement entered into between the Chief, the Mayor of the District of Columbia, and the District of Columbia Financial Responsibility and Management Assistance Authority. (b) Appointment and Removal During Control Year.— (1) Appointment.— During a control year, the Chief of the Metropolitan Police Department of the District of Columbia shall be appointed by the Mayor of the District of Columbia as follows: (A) Prior to appointment, the District of Columbia Financial Responsibility and Management Assistance Authority (hereafter in this subsection referred to as the “Authority”) may submit recommendations for the appointment to the Mayor. (B) In consultation with the Authority and the Council of the District of Columbia, the Mayor shall nominate an individual for appointment and notify the Council of the nomination. 112 STAT. 101 (C) After the expiration of the 7-day period which begins on the date the Mayor notifies the Council of the nomination under subparagraph (B), the Mayor shall notify the Authority of the nomination. (D) The nomination shall be effective subject to approval by a majority vote of the Authority. (2) Removal.— During a control year, the Chief of the Metropolitan Police Department of the District of Columbia may be removed by the Authority or by the Mayor with the approval of the Authority. (3) Control year defined.— In this subsection, the term “control year” has the meaning given such term in section 305(4) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995. (c) Effective Date.— This section shall be effective as of April 21, 1998.
