SEC. 103. AGREEMENTS WITHIN THE SCOPE OF THE ACT. (a) Ocean Common Carries.—Section 4(a) of the Shipping Act of 1984 (46 U.S.C. App. 1703(a)) is amended by— (1) striking “operators or non–vessel–operating common carriers;” in paragraph (5) and inserting “operators;” (2) striking “and” in paragraph (6) and inserting “or” and (3) striking paragraph (7) and inserting the following: “(7) discuss and agree on any matter related to service contracts.”. (b) Marine Terminal Operators.—Section 4(b) of that Act (46 U.S.C. App. 1703(b)) is amended by— (1) striking “(to the extent the agreements involve ocean transportation in the foreign commerce of the United States)”; (2) striking “and” in paragraph (1) and inserting “or” and (3) striking “arrangements.” in paragraph (2) and inserting “arrangements, to the extent that such agreements involve ocean transportation in the foreign commerce of the United States.”.
