SEC. 407. LIMITATION ON DAILY AVERAGE OF PERSONNEL ON ACTIVE DUTY IN GRADES E–8 AND E–9. (a) Fiscal Year Basis for Application of Limitation.— The first sentence of section 517(a) of title 10, United States Code, is amended— (1) by striking out “a calendar year” and inserting in lieu thereof “a fiscal year”; and (2) by striking out “January 1 of that year” and inserting in lieu thereof “the first day of that fiscal year”. (b) Effective Date.— The amendments made by subsection (a) shall take effect on October 1, 1999.112 STAT. 1997
