Sec. 117. Section 402 of the Controlled Substances Act (21 U.S.C. 842) is amended— (1) in subsection (a)(5), by inserting “negligently” before “fail”;112 STAT. 2681–69 (2) in subsection (a)(10), by inserting “negligently” before “to fail”; and (3) in subsection (c)(1)— (A) by inserting “(A)” after “(1)”; (B) by inserting “subparagraph (B) of this paragraph and” before “paragraph (2)”; and (C) by adding at the end the following: “(B) In the case of a violation of paragraph (5) or (10) of subsection (a), the civil penalty shall not exceed $10,000.”.
