SEC. 702. KIDNAPPING. (a) Clarification of Element of Offense.— Section1201(a)(1) of title 18, United States Code, is amended by inserting “, regardless of whether the person was alive when transported across a State boundary if the person was alive when the transportation began” before the semicolon. (b) Technical Amendment.— Section 1201(a)(5) of title 18, United States Code, is amended by striking “designated” and inserting “described”. (c) 24–Hour Rule.— Section 1201(b) of title 18, United States Code, is amended by adding at the end the following: “Notwithstanding the preceding sentence, the fact that the presumption under this section has not yet taken effect does not preclude a Federal investigation of a possible violation of this section before the 24-hour period has ended.”.
