SEC. 4734. PENALTY FOR FRAUDULENT ELIGIBILITY. Section 1128B(a) (42 U.S.C. 1320a–7b(a)), as amended by section 217 of the Health Insurance Portability and Accountability Act of 1996 (Public Law 104–191; 110 Stat. 2008), is amended— (1) by striking paragraph (6) and inserting the following: “(6) for a fee knowingly and willfully counsels or assists an individual to dispose of assets (including by any transfer in trust) in order tor the individual to become eligible for medical assistance under a State plan under title XIX, if disposing of the assets results in the imposition of a period of ineligibility for such assistance under section 1917(c),"; and (2) in clause (ii) of the matter following such paragraph, by striking “failure, or conversion by any other person” and 111 STAT. 523inserting “failure, conversion, or provision of counsel or assistance by any other person”.
