SEC. 1311. CLARIFICATION OF TREATMENT OF SURVIVOR ANNUITIES UNDER QUALIFIED TERMINABLE INTEREST RULES. (a) In General.—Subparagraph (C) of section 2056(b)(7) is amended by inserting “(or, in the case of an interest in an annuity arising under the community property laws of a State, included in the gross estate of the decedent under section 2033)” after “section 2039”. (b) Effective Date.—The amendment made by this section shall apply to estates of decedents dying after the date of the enactment of this Act.
