SEC. 212. LENDING TO AN AFFILIATED INVESTMENT COMPANY. Section 17(a) of the Investment Company Act of 1940 (15 U.S.C. 80a–17(a)) is amended— (1) by striking “or” at the end of paragraph (2); (2) by striking the period at the end of paragraph (3) and inserting “; or”; and (3) by adding at the end the following new paragraph:113 STAT. 1397 “(4) to loan money or other property to such registered company, or to any company controlled by such registered company, in contravention of such rules, regulations, or orders as the Commission may, after consultation with and taking into consideration the views of the Federal banking agencies (as defined in section 3 of the Federal Deposit Insurance Act), prescribe or issue consistent with the protection of investors.”.
