SEC. 353. COOPER RIVER, CHARLESTON HARBOR, SOUTH CAROLINA. (a) In General.—The project for rediversion, Cooper River, Charleston Harbor, South Carolina, authorized by section 101 of the River and Harbor Act of 1968 (82 Stat. 731) and modified by title I of the Energy and Water Development Appropriations Act, 1992 (105 Stat. 517), is further modified to authorize the Secretary to pay to the State of South Carolina not more than $3,750,000 if the Secretary and the State enter into a binding agreement for the State to perform all future operation of the 113 STAT. 311fish lift at St. Stephen, South Carolina, including performance of studies to assess the efficacy of the fish lift. (b) Contents of Agreement.—The agreement under subsection (a) shall specify— (1) the terms and conditions under which payment will be made; and (2) the rights of, and remedies available to, the Federal Government to recover all or a portion of the payment if the State suspends or terminates operation of the fish lift or fails to operate the fish lift in a manner satisfactory to the Secretary. (c) Maintenance.—Maintenance of the fish lift shall remain a Federal responsibility.
