SEC. 1504. AUTHORIZATION OF USE OF FUNDS FOR MILITARY CONSTRUCTION PROJECTS. (a) Authority for Use of Funds.—Qualified emergency defense appropriations may be used to acquire real property and carry out military construction projects not otherwise authorized by law that the Secretary of Defense determines are necessary to respond to or protect against acts or threatened acts of terrorism or to respond to the terrorist attacks on the United States that occurred on September 11, 2001. (b) Project Authorization.—Any project with respect to which the Secretary makes a determination under subsection (a) and that is to be carried out using qualified emergency defense appropriations is hereby authorized for purposes of section 2802 of title 10, United States Code. (c) Qualified Emergency Defense Appropriations.—For purposes of this subsection, the term “qualified emergency defense appropriations” means emergency appropriations available to the Department of Defense that are authorized by section 1502 or 1503.
