SEC. 2812. AVAILABILITY OF PROCEEDS OF SALES OF DEPARTMENT OF DEFENSE PROPERTY FROM CERTAIN CLOSED MILITARY INSTALLATIONS. (a) Modification of Availability Percentages.—Subsection (h)(2) of section 204 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C. 485) is amended by striking subparagraphs (A) and (B) and inserting the following new subparagraphs: “(A) In the case of property located at a military installation that is closed, such amount shall be available for facility maintenance and repair or environmental restoration by the military department that had jurisdiction over such property before the closure of the military installation. “(B) In the case of property located at any other military installation— 115 STAT. 1308 “(i) 50 percent of such amount shall be available for facility maintenance and repair or environmental restoration at the military installation where such property was located before it was disposed of or transferred; and “(ii) 50 percent of such amount shall be available for facility maintenance and repair and for environmental restoration by the military department that had jurisdiction over such property before it was disposed of or transferred.”. (b) Relation to Other Laws.—Subsection (h) of such section is further amended— (1) in paragraph (1), by inserting “pursuant to a base closure law” after “realignment” in the first sentence; and (2) in paragraph (5), by inserting before the period at the end the following: “, and the term ‘base closure law’ shall have the meaning given that term in section 2667(h)(2) of such title”.
