SEC. 312. PRIVATE PRACTICE. Section 338D of the Public Health Service Act (42 U.S.C. 254n) is amended by striking subsection (b) and inserting the following: “(b)(1) The written agreement described in subsection (a) shall—116 STAT. 1651 “(A) provide that, during the period of private practice by an individual pursuant to the agreement, the individual shall comply with the requirements of section 334 that apply to entities; and “(B) contain such additional provisions as the Secretary may require to carry out the objectives of this section. “(2) The Secretary shall take such action as may be appropriate to ensure that the conditions of the written agreement prescribed by this subsection are adhered to.”.
