SEC. 2812. RETENTION AND AVAILABILITY OF AMOUNTS REALIZED FROM ENERGY COST SAVINGS.(a) In General.—Section 2865(b) of title 10, United States Code, is amended—(1) in paragraph (1), by striking “Two-thirds of the portion of the funds appropriated” and inserting “An amount of the funds appropriated”; (2) in paragraph (2), by striking “The Secretary” and inserting “The Secretary of Defense”; and(3) by adding at the end the following new paragraph:“(4) The Secretary of Defense shall include in the budget material submitted to Congress in connection with the submission of the budget for a fiscal year pursuant to section 1105 of title 31 a separate statement of the amounts available for obligation under this subsection in such fiscal year.”. (b) Effective Date.—The amendment made by subsection (a)(1) shall not apply to funds appropriated for a fiscal year before fiscal year 2004.
