Sec. 128. Treatment of Certain Waste Materials. (a) In General.—Notwithstanding any other provision of law, the Federal commission with the authority to regulate the material designated as “11e.(2) by-product material” by section 312 of the Energy and Water Development Appropriations Act, 2004, or by section 634 of the Energy Policy Act of 2003, shall not allow or otherwise permit any facility to receive or dispose of such material if the facility is located in a State that has an application pending under section 274 of the Atomic Energy Act of 1954 (42 U.S.C. 2021) to regulate the 11e.(2) material covered under this section.(b) Sunset.—Subsection (a) ceases to be effective January 1, 2005.
