SEC. 231. FIELDING OF BALLISTIC MISSILE DEFENSE CAPABILITIES.(a) Authority.—Funds described in subsection (b) may, upon approval by the Secretary of Defense, be used for the development and fielding of ballistic missile defense capabilities.(b) Covered Funds.—Subsection (a) applies to funds appropriated for fiscal year 2005 or fiscal year 2006 for research, development, test, and evaluation for the Missile Defense Agency.
