Sec. 338. (a) In General.—Notwithstanding any other provision of subchapter I of Chapter 471 of title 49, the Secretary of Transportation may provide grants under such subchapter I of chapter 471 to the airport sponsor of the Double Eagle II Airport in Albuquerque, New Mexico, for—(1) the construction of an air traffic control tower; and(2) the acquisition and installation of air traffic control equipment to be used in the air traffic control tower that will assist in sustaining or improving the safe and efficient movement of air traffic.(b) Eligibility.—The sponsor shall be eligible for a grant under this section if—(1) the sponsor would otherwise be eligible to participate in the pilot program established under section 47124(b)(3) of title 49 except for the lack of the air traffic control tower proposed to be constructed under this section; and(2) the sponsor agrees to fund not less than 10 percent of the costs of construction of the air traffic control tower.117 STAT. 416(c) Project Costs.—Grants under this act shall be paid only from amounts apportioned to the sponsor or for airports in the State under section 47114(d) of title 49, United States Code.(d) Federal Cost.—The Federal cost of construction of an air traffic control tower under this section may not exceed $1,800,000.
