SEC. 404. MONITORING OF PACIFIC INSULAR AREA FISHERIES.(a) Waiver Authority.—Section 201(h)(2)(B) (16 U.S.C. 1821(h)(2)(B)) is amended by striking “that is at least equal in effectiveness to the program established by the Secretary;” and inserting “or other monitoring program that the Secretary, in consultation with the Western Pacific Management Council, determines is adequate to monitor harvest, bycatch, and compliance with the laws of the United States by vessels fishing under the agreement;”.(b) Marine Conservation Plans.—Section 204(e)(4)(A)(i) (16 U.S.C. 1824(e)(4)(A)(i)) is amended to read as follows:120 STAT. 3633 “(i) Pacific Insular Area observer programs, or other monitoring programs, that the Secretary determines are adequate to monitor the harvest, bycatch, and compliance with the laws of the United States by foreign fishing vessels that fish under Pacific Insular Area fishing agreements;”.
