SEC. 2003. REVIEW OF GOOD FAITH DETERMINATIONS RELATED TO WETLAND CONSERVATION. Section 1222(h) of the Food Security Act of 1985 (16 U.S.C. 3822(h)) is amended—(1) by redesignating paragraph (2) as paragraph (3);(2) by inserting after paragraph (1) the following new paragraph:“(2) Eligible reviewers.—A determination of the Secretary, or a designee of the Secretary, under paragraph (1) shall be reviewed by the applicable—“(A) State Executive Director, with the technical concurrence of the State Conservationist; or“(B) district director, with the technical concurrence of the area conservationist.”; and(3) in paragraph (3) (as redesignated by paragraph (1)), by inserting “be” before “actively”.
