SEC. 4112. TECHNICAL CLARIFICATION REGARDING ELIGIBILITY. Section 6(k) of the Food and Nutrition Act of 2008 (7 U.S.C. 2015(k)) is amended—(1) by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;(2) by striking “No member” and inserting the following:“(1) In general.—No member”; and(3) by adding at the end the following:“(2) Procedures.—The Secretary shall—“(A) define the terms ‘fleeing’ and ‘actively seeking’ for purposes of this subsection; and“(B) ensure that State agencies use consistent procedures established by the Secretary that disqualify individuals whom law enforcement authorities are actively seeking for the purpose of holding criminal proceedings against the individual.”.
