SEC. 1540. TRUCK SECURITY ASSESSMENT.(a) Definition.—For the purposes of this section, the term “truck” means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport property when the vehicle—(1) has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or(2) is used in transporting material found by the Secretary of Transportation to be hazardous under section 5103 of title 49, United States Code, and transported in a quantity requiring placarding under regulations prescribed by the Secretary under subtitle B, chapter I, subchapter C of title 49, Code of Federal Regulations.(b) In General.—Not later than 1 year after the date of enactment of this Act, the Secretary, in coordination with the Secretary of Transportation, shall transmit a report to the appropriate congressional committees on truck security issues that includes—(1) a security risk assessment of the trucking industry;(2) an assessment of actions already taken by both public and private entities to address identified security risks;(3) an assessment of the economic impact that security upgrades of trucks, truck equipment, or truck facilities may have on the trucking industry and its employees, including independent owner-operators;(4) an assessment of ongoing research by public and private entities and the need for additional research on truck security;(5) an assessment of industry best practices to enhance security; and(6) an assessment of the current status of secure truck parking.(c) Format.—The Secretary may submit the report in both classified and redacted formats if the Secretary determines that such action is appropriate or necessary.121 STAT. 469
