Sec. 804. (a) Notwithstanding any other provision of law, during the period from September 1 through September 30, 2009, the Secretary of Education shall transfer to the Career, Technical, and Adult Education account an amount not to exceed $10,260,000 from amounts that would otherwise lapse at the end of fiscal year 2009 and that were originally made available under the Department of Education Appropriations Act, 2009 or any Department of Education Appropriations Act for a previous fiscal year.(b) Funds transferred under this section to the Career, Technical, and Adult Education account shall be obligated by September 30, 2009.(c) Any amounts transferred pursuant to this section shall be for carrying out Adult Education State Grants, and shall be allocated, notwithstanding any other provision of law, only to those States that received funds under that program for fiscal year 2009 123 STAT. 1887 that were at least 9.9 percent less than those States received under that program for fiscal year 2008.(d) The Secretary shall use these additional funds to increase those States’ allocations under that program up to the amount they received under that program for fiscal year 2008.(e) The Secretary shall notify the Committees on Appropriations of both Houses of Congress of any transfer pursuant to this section.
