SEC. 3041. ADJUSTMENTS FOR FISCAL YEAR 2005. (a) In General.—Notwithstanding any other provision of law, the Secretary shall ensure that the total apportionments and allocations made for fiscal year 2005 to each grant recipient under the Federal Transit Administration programs shall not exceed the amount made available under section 5338 of title 49, United States Code, as amended by this title, for fiscal year 2005 plus prior year balances. (b) Fixed Guideway Modernization Adjustment.—In making the apportionments described in subsection (a), the Secretary shall adjust the amount apportioned for fiscal year 2005 to each urbanized area for fixed guideway modernization to reflect the apportionment method set forth in section 5337(a) of title 49, United States Code. (c) Reconciliation.—Funds authorized by or made available under section 5338, as amended by this title, for fiscal year 2005— (1) shall not be subject to the across-the-board rescissions in section 122 of division J of Public Law 108–477; (2) shall be transferred or made available for the purposes as indicated in division H of Public Law 108–477, as amended by Public Law 109–13; and (3) shall be administered consistent with the applicable formula authorized under Public Law 105–178, as amended. * * * * * * *
