SEC. 716. PROTECTION AGAINST INTENTIONAL ADULTERATION. Section 303(b) (21 U.S.C. 333(b)) is amended by adding at the end the following: ā€œ(7) Notwithstanding subsection (a)(2), any person that knowingly and intentionally adulterates a drug such that the drug is adulterated under subsection (a)(1), (b), (c), or (d) of section 501 and has a reasonable probability of causing serious adverse health consequences or death to humans or animals shall be imprisoned for not more than 20 years or fined not more than $1,000,000, or both.ā€ .
