8003.(a)Funds appropriated by this title in this Act under the headings Diplomatic and Consular Programs and Embassy Security, Construction, and Maintenance may be transferred to, and merged with, funds appropriated by this title under such headings.(b)Funds appropriated by this title in this Act under the headings Economic Support Fund, International Narcotics Control and Law Enforcement, Nonproliferation, Anti-terrorism, Demining and Related Programs, Peacekeeping Operations, and Foreign Military Financing Program may be transferred to, and merged with—(1)funds appropriated by this title under such headings; and(2)funds appropriated by this title under the headings International Disaster Assistance and Migration and Refugee Assistance.(c)Notwithstanding any other provision of this section, of the funds appropriated by this title in this Act not to exceed $400,000,000 from funds appropriated under the heading Economic Support Fund, not to exceed $10,000,000 from funds appropriated under the heading International Narcotics Control and Law Enforcement, and not to exceed $50,000,000 from funds appropriated under the heading Foreign Military Financing Program may be transferred to, and merged with, funds made available under the heading Complex Crises Fund: Provided, That upon determination that all or part of the funds so transferred from such appropriations are not necessary for the purposes for which they were transferred, such amounts may be transferred back to such appropriation and shall be available for the same purposes and for the same time period as originally appropriated.(d)Notwithstanding any other provision of this section, not to exceed $25,000,000 from funds appropriated under the headings International Narcotics Control and Law Enforcement, Peacekeeping Operations, and Foreign Military Financing Program by this title in this Act may be transferred to, and merged with, funds previously made available under the heading Global Security Contingency Fund: Provided, That not later than 15 days prior to making any such transfer, the Secretary of State shall notify the Committees on Appropriations on a country basis, including the implementation plan and timeline for each proposed use of such funds.(e)The transfer authority provided in subsections (a) and (b) may only be exercised to address unanticipated contingencies: Provided, That no such transfer shall exceed 15 percent of any appropriation made available for the current fiscal year by this title and no such appropriation shall be increased by more than 25 percent by any such transfer.(f)The transfer authority provided by this section shall be subject to the regular notification procedures of the Committees on Appropriations: Provided, That such transfer authority is in addition to any transfer authority otherwise available under any other provision of law, including section 610 of the Foreign Assistance Act of 1961 which may be exercised by the Secretary of State for the purposes of this title.
