PROHIBITION ON RECEIPT OF UNEMPLOYMENT INSURANCE WHILE RECEIVING POST-9/11 EDUCATION ASSISTANCE.

SEC. 560. PROHIBITION ON RECEIPT OF UNEMPLOYMENT INSURANCE WHILE RECEIVING POST-9/11 EDUCATION ASSISTANCE. (a) Effect of Receipt of Post-9/11 Education Assistance.—Section 8525(b) of title 5, United States Code, is amended— (1) in the matter preceding paragraph (1), by striking “he receives” and inserting “the individual receives”; (2) in paragraph (1), by striking “or” after the semicolon; (3) by redesignating paragraph (2) as paragraph (3); and (4) by inserting after paragraph (1) the following new paragraph (2): “(2) except in the case of an individual described in subsection (a), an educational assistance allowance under chapter 33 of title 38; or” . (b) Exception.—Section 8525 of title 5, United States Code, is amended by inserting before subsection (b) the following new subsection: “(a) Subsection (b)(2) does not apply to an individual who— “(1) is otherwise entitled to compensation under this subchapter; “(2) is described in section 3311(b) of title 38; “(3) is not receiving retired pay under title 10; and “(4) was discharged or released from service in the Armed Forces or the Commissioned Corps of the National Oceanic and Atmospheric Administration (including through a reduction in force) under honorable conditions, but did not voluntarily separate from such service.” .
