CORRECTIVE ACTION FOR CERTAIN DEPARTMENT OF VETERANS AFFAIRS EMPLOYEES FOR CONFLICTS OF INTEREST WITH EDUCATIONAL INSTITUTIONS OPERATED FOR PROFIT.
SEC. 302. CORRECTIVE ACTION FOR CERTAIN DEPARTMENT OF VETERANS AFFAIRS EMPLOYEES FOR CONFLICTS OF INTEREST WITH EDUCATIONAL INSTITUTIONS OPERATED FOR PROFIT.
(a) In General.âSection 3683 of title 38, United States Code, is amendedâ
(1) by striking subsection (a) and inserting the following:
â(a) Department Officers and Employees.â(1) An officer or employee of the Department shall receive corrective action or disciplinary action if such officer or employeeâ
â(A) has, while serving as such an officer or employee, owned any interest in, or received any wage, salary, dividend, profit, or gift from, any educational institution operated for profit; or
â(B) has, while serving as a covered officer or employee of the Department, received any service from any educational institution operated for profit.
â(2) In this subsection, the term âcovered officer or employee of the Departmentâ means an officer or employee of the Department whoâ
â(A) works on the administration of benefits under chapter 30, 31, 32, 33, 34, 35, or 36 of this title; or
â(B) has a potential conflict of interest involving an educational institution operated for profit, as determined by the Secretary.â

(2) in subsection (b)â
(A) by striking âIf the Secretaryâ and inserting the following:
â(b) State Approving Agency Employees.âIf the Secretaryâ
;
(B) by striking âwages, salary, dividends, profits, gratuities, or servicesâ and inserting âwage, salary, dividend, profit, or giftâ;
(C) by striking âin which an eligible person or veteran was pursuing a program of education or course under this chapter or chapter 34 or 35 of this titleâ;
(D) by striking âterminate the employment ofâ and inserting âprovide corrective action or disciplinary action with respect toâ; and
(E) by striking âwhile such person is an officer or employee of the State approving agency, or State department of veteransâ affairs or State department of educationâ and inserting âuntil the completion of such corrective action or disciplinary actionâ;
(3) in subsection (c)â
(A) by striking âA State approving agencyâ and inserting the following:
â(c) Disapproval of Courses.âA State approving agencyâ

(B) by striking âof Veterans Affairsâ; and
(C) by striking âwages, salary, dividends, profits, gratuities, or servicesâ and inserting âwage, salary, dividend, profit, or giftâ; and
(4) in subsection (d)â
(A) by striking âThe Secretary mayâ and inserting the following:
â(d) Waiver Authority.â(1) The Secretary mayâ

(B) by striking âof Veterans Affairsâ;
(C) by striking â, after reasonable notice and public hearings,â; and
(D) by adding at the end the following new paragraph:
â(2) The Secretary shall provide public notice of any waiver granted under this subsection by not later than 30 days after the date on which such waiver is granted.â

(b) [38 U.S.C. 3683 note] Effective Date.âThe amendments made by subsection (a) shall take effect on the date of the enactment of this Act and shall apply with respect to conflicts of interest that occur on or after that date.
