SEC. 1108. PANDEMIC EBT PROGRAM. Section 1101 of the Families First Coronavirus Response Act (7 U.S.C. 2011 note; Public Law 116-127) is amended— (1) in subsection (a)— (A) by striking ā€œDuring fiscal years 2020 and 2021ā€ and inserting ā€œIn any school year in which there is a public health emergency designationā€; and (B) by inserting ā€œor in a covered summer period following a school sessionā€ after ā€œin sessionā€; (2) in subsection (g), by striking ā€œDuring fiscal year 2020, theā€ and inserting ā€œTheā€; (3) in subsection (h)(1)— (A) by inserting ā€œeitherā€ after ā€œat least 1 child enrolled in such a covered child care facility andā€; and (B) by inserting ā€œor a Department of Agriculture grant-funded nutrition assistance program in the Commonwealth of the Northern Mariana Islands, Puerto Rico, or American Samoaā€ before ā€œshall be eligible to receive assistanceā€; (4) by redesignating subsections (i) and (j) as subsections (j) and (k), respectively; (5) by inserting after subsection (h) the following: ā€œ(i) Emergencies During Summer.—The Secretary of Agriculture may permit a State agency to extend a State agency plan approved under subsection (b) for not more than 90 days for the purpose of operating the plan during a covered summer period, during which time schools participating in the school lunch program under the Richard B. Russell National School Lunch Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773 ) and covered child care facilities shall be deemed closed for purposes of this section.ā€ ; (6) in subsection (j) (as so redesignated)— (A) by redesignating paragraphs (2) through (6) as paragraphs (3) through (7), respectively; (B) by inserting after paragraph (1) the following: ā€œ(2) Covered summer period.—The term ā€˜covered summer period’ means a summer period that follows a school year during which there was a public health emergency designation.ā€ ; and (C) in paragraph (5) (as so redesignated), by striking ā€œor another coronavirus with pandemic potentialā€; and (7) in subsection (k) (as so redesignated), by inserting ā€œFederal agencies,ā€ before ā€œState agenciesā€.
