SEC. 212. MODIFICATION TO ANNUAL REPORT ON UNFUNDED PRIORITIES OF THE UNDER SECRETARY OF DEFENSE FOR RESEARCH AND ENGINEERING. The second section 222e of title 10, United States Code, is amended— (1) in subsection (a), by striking “the Secretary of Defense shall” and inserting “the Secretary of Defense, after coordinating with the Secretaries of the military departments, shall”; and (2) in subsection (e)— (A) in paragraph (1), by striking “and” at the end; (B) in paragraph (2), by striking the period at the end and inserting “; and”; and (C) by adding at the end the following new paragraph: “(3) in the case of a military construction project, has reached 35 percent design.” .
