AMENDMENTS TO THE ENERGY EMPLOYEES OCCUPATIONAL ILLNESS COMPENSATION PROGRAM ACT OF 2000.

SEC. 5501. AMENDMENTS TO THE ENERGY EMPLOYEES OCCUPATIONAL ILLNESS COMPENSATION PROGRAM ACT OF 2000. (a) [42 U.S.C. 7384 note] Short Title.—This section may be cited as the “Beryllium Testing Fairness Act”. (b) Modification of Demonstration of Beryllium Sensitivity.—Section 3621(8)(A) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7384l(8)(A)) is amended— (1) by striking “established by an abnormal” and inserting the following:“established by— “(i) an abnormal” ; (2) by striking the period at the end and inserting “; or”; and (3) by adding at the end the following: “(ii) three borderline beryllium lymphocyte proliferation tests performed on blood cells over a period of 3 years.” . (c) Extension of Advisory Board on Toxic Substances and Worker Health.—Section 3687(j) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7385s-16(j)) is amended by striking “10 years” and inserting “15 years”.
