SEC. 323. [10 U.S.C. 2911 note] NOTIFICATION REQUIREMENT WITH RESPECT TO NUCLEAR POWER IN GUAM. (a) Notification.—Except as provided in subsection (b), the Secretary of Defense shall, not later than one year before any date on which the Secretary carries out the placement of a permanent nuclear reactor in Guam, submit to Congress and the Governor of Guam a notification of such placement. (b) Exception.—Subsection (a) shall not apply to a nuclear reactor aboard a naval vessel. (c) Nuclear Reactor Defined.—In this section, the term “nuclear reactor” has the meaning given the term “advanced nuclear reactor” in section 951 of the Energy Policy Act of 2005 (42 U.S.C. 16271).
