INFORMATIONAL MEMORANDUM OIR-08-3M ISSUED June 23, 2008 Office of Insurance Regulation Kevin M. McCarty Commissioner All Life and Health Insurers and All Health Maintenance Organizations (HMOs) Bone Marrow Transplant Procedures and Identification Cards The purpose of this memorandum is to notify Life and Health Insurers of legislative changes to Section 627.4236, Florida Statutes, (F.S.) enacted in the 2008 Regular Session of the Florida Legislature. This notice is not intended to be a comprehensive analysis of the bill. You are encouraged to review specific bills found by legislative bill number at www.leg.state.fl.us. HOUSE BILL 535 Section 627.4236, F.S. is amended to revise the meaning of “bone marrow transplant” to include non-ablative therapy with curative or life-prolonging intent. Section 627.642, F.S. is amended to specify that an Outline of Coverage must be accompanied by an identification card that contains minimum information as stated in newly added ss. (3). Section 627.657, F.S. is amended to specify that identification cards of group health insurance policies must contain minimum information as stated in newly added ss. (2). Section 641.31, F.S. is amended to specify that identification cards for health maintenance contracts must contain minimum information as stated in newly added ss. (41). This act is effective January 1, 2009, and requires filing of an amendment to existing and approved forms with the Florida Office of Insurance Regulation to ensure compliance with the new statutory provisions. Identification cards are not required to be filed.
