CLARIFYING LANGUAGE ON PAYMENTS MADE BY INSURERS TO AND ON BEHALF OF INSUREDS

KING INSURANCE AND SAFETY FIRE COMMISSIONER DATE: NOVEMBER 22, 2021 RE: CLARIFYING LANGUAGE ON PAYMENTS MADE BY INSURERS TO AND ON BEHALF OF INSUREDS ______________________________________________________________________________ It has come to my attention that, since the enactment of House Bill 254, questions have been raised about the method in which insurers can make payments to and on behalf of insureds. It is the Department’s position that the provisions of House Bill 254 only apply to payments involving public adjusters. The Department recognizes that insurers may, for the convenience of their insureds, issue payments and/or reimbursements on behalf of their insureds to others who have provided services to the insured. Further, the Department recognizes that those payments may be made electronically, or by any other method allowed under Georgia law. _____________________________________________ JOHN F.
