OCGA 33-1-27(b)(4) requires that “[n]o later than January 1, 2023, and annually thereafter,
submit a report to the Commissioner that contains the designated comparative analyses and other
information designated by the Commissioner for that reporting year for insurers under the
Mental Health Parity and Addiction Equity Act of 2008, 42 U.S.C. Section 300gg-26(a)(8)(A)
and which delineates the comparative analysis and written processes and strategies used to apply
benefits for children, adolescents, and adults.”
On November 29, 2022, this office released Bulletin 22-EX-7 to insurers offering instructions on
how to file mental health parity data to meet the requirements of OCGA 33-1-27(b)(4). This
Bulletin offers a small clarification to Bulletin 22-EX-7. Insurers will be deemed to have met the
requirements of OCGA 33-1-27(b)(4) if they submit to the Department the same analysis and
form they submit to the CMS to show compliance with 42 U.S.C. Section 300gg-26(a)(8)(A).
Insurers who have yet to submit anything to CMS to show compliance with 42 U.S.C. Section
300gg-26(a)(8)(A) should refer to the instructions set forth in Bulletin 22-EX-7.
