Hayashida SUBJECT: Elimination of Requirement to Submit Forms Used by Vehicle Protection Product Warrantors and Service Contract Providers in Hawaiʻi Act 016, signed into law by Governor David. Y. Ige on April 23, 2019, removes the requirement that all Vehicle Protection Product Warrantors ("VPPWs") and Service Contract Providers ("SCPs") submit to the Insurance Commissioner a copy of each service contract or warranty form proposed for use in this State. Registration requirements codified in Hawaiʻi Revised Statutes ("HRS") §§ 481R-4 and 481X-3 are amended by removing the form submission requirement. Act 016 takes effect on July 1, 2019. After July 1, 2019, service contract or warranty forms submitted will not be accepted and will be returned or destroyed at the discretion of the Insurance Division. VPPWs and SCPs are still required to maintain copies of any service contract or warranty form sold in this State, in compliance with recordkeeping requirements set forth in HRS §§ 481R-8 and 481X-5.
