HAR §17-1722-127. Rebate agreement

(a) A drug
manufacturer that sells prescription drugs in the
State and who enters into a rebate agreement with the
department shall be required to make rebate payments
to the department according to a schedule established
by the department.
(b) The department or its designee shall attempt
to obtain a rebate amount that is equal to or greater
than the amount of any discount, rebate, or price
reduction for prescription drugs provided to
the federal government pursuant to 42 U.S.C. Section
