(a) The operation of a child care facility without a license is a violation and shall be punishable by a fine not to exceed the maximum amount allowable under the law. (b) The following offenses may be punishable by a fine, not to exceed the maximum amount allowable under the law, and may also be subject to the denial, suspension, or revocation of a license: (1) Caring for more children than allowed by the facility's license; (2) Violation of the staff-child ratios; (3) Improperly certifying staff credentials; (4) Failure to comply with timely request for background check as required in chapter 801; (5) Allowing conditions to exist at the facility 896.1-13 3546 §17-896.1-4 which constitute a risk of harm or an imminent danger to the health, welfare, or safety of the children; or injuries to children resulting from the conditions; (6) Failure to report suspected child abuse or neglect that has occurred or will occur; (7) Any behavior that may create an unsafe or unhealthy environment or may pose a risk of harm to children.
