Un~ass the context clearly i ndicates otherwise, as used in this chapter: "Aircraft" means any contrivance used or designed for navigation of or !light in tha air, including, but not limited to, airplanes, helicopters, and gliders . "Department" means the State of Hawaii department of transportation. "owner" means any person who claims, expressly or othe rwise , lawful care, custody, or control of an ai rcraft by virtue of legal title or equitable interest therein which entitle that person to posses sion, or a lessee of a leased airc .raft which lease excludes the title holde r fr0111 any rights to usa or possession of the aircraft while under l ease to the lessee. (a ) No pe rson op erat e any air cra ft a t any p ublic ai rport u nles s the shall ai rcra ft: by: ( 1) ( 2 ) ( 3) (b) Has been re gist ered with th e de pa rtment; Has a curre nt certificate o f regis tra tion issued by the depa rt ment; an d Has a curr ent dec al issued b y the de par tme nt a ffix ed on or near th e lower le ft h and corner of the a irc raft wi ndsh ield in suc h a way that it is a t all times v isib le from ou tsid e the aircr aft. The ai rcraft's owne r shall r egis ter the ai rcr aft (1) Obtaining an aircraft reg istra tion appl icatio n form fr om any St ate of Ha waii airp orts div ision dist rict off ice, comple tin g i t, and submitting it to the district office; the info rmati on pro vided on thi s fo rm shall incl ude: (A) T he owner' s: (i) Na me; ( ii) Addr ess; and (iii) Phon e nu mber. (B) The aircraft's: ( i) Unit ed States ide ntifi catio n number ( N-number) ; ( ii) Type (airpl ane, h elico pter or gli der); ( iii) Make; ( iv) M odel; (v) Year o f man ufactu re; (vi) C ol or; and (vii) Ho me ba se. (2) P aying a $1 0 re gistration fee. (c) Af ter receivin g the com plet ed registrati on a ppli cation form and $ 10 regi stra tion fee, th e dep art ment sha ll revi ew the appli ca tion and, if it is in order, sha ll issue a cer tif icat e of re gist rati on and aircr aft decal to th e ow ner. (d) The ce rtif icat e of regis trat ion and the d ecal shal l be: (1) (2 ) Va lid for th e cale ndar ye ar; and Tr ans fera ble. (T he new owner sha ll notify depar tment of the change in owne rship in accordance with section 19-31.1-3.) 31.1-2 the §19-31.1-5 (e) The owner shall: (1 ) Kee p th e cereificat e o f registratio n i n th e aircra ft a nd displ ay it up on reque st by an authori zed representat ive of the departme n~. (2) A ffix the d eca l o n or near the l ower left hand c orn er o f the aircraft winds hie ld in s uch a way that it is at all times v isibl e from o utsi de the ai rcraf t. ( b) A fter receivin g the $1 0 reg istr ation renew al fee , the d epar tment shall is sue a new document ation of · reg istrat ion whic h shall be valid for th e en sui ng c alendar year . (c) I f the re gistra tion expi res without bei ng ren ewed, th e aircraft' s ow ner shall be s ubje~~ to the pen alties set fort h in section 19-31. 1-7. The followin g ar e exempt from this chapter: (1 ) Aircraf t operat ing primar ily in com merce bet ween the state of Hawa ii and: (A) An y o ther Sta te in th e United Stat es; or ( B) Any fo reign cou ntr y; (2) Air craft ow ned or operat ed by the U nited St ates ; (3) Ai rcraft i n tr ansit through the State of Hawaii; and 31.1-3 §19-31.1-5 (4) Aircraft operated by any scheduled air carrier whic h i s a lesse e o f th e departmen~ unde r a n airport-airli ne leas e.
