(a) The chairperson may set, charge, and collect administrative fines and costs, as allowed by law, or bring legal action to recover administrative fees and costs as documented by receipts or affidavit, including attorneys' fees and costs; or bring legal action to recover administrative fines, fees, and costs, including attorneys' fees and costs, or payment for damages resulting from a violation of chapter 141D, HRS, or any rule adopted pursuant to chapter 141D, HRS. (b) Any criminal action against a person for any violation of chapter 141D, HRS, shall not be deemed to preclude the State from pursuing civil legal action 159-14 3620 4-159-5 against that person. Any civil legal action against a person to recover administrative fines and costs for any violation of chapter 141D, HRS, or any rule adopted pursuant to chapter 141D, HRS, shall not be deemed to preclude the State from pursuing any criminal action against that person. Each day of each violation shall constitute a separate offense. (c) A violation of any provision in this chapter shall be cause for the board to cancel the lease and take possession of the land, or take other action as the board, in its sole discretion, deems appropriate; provided that the board shall provide notice to the lessee of the violation in accordance with rules adopted pursuant to section 141D-7, HRS.
