(a)
The director may
enter and i nspect any bui l ding or place, as set forth
in section 342P- 4, HRS, to investigate an actual or
suspected source, use, or presence of l ead, to
ascertain compliance or non - compliance with this
chapter or any order issued by the department pursuant
to this chapter, and to make reasonable tests i n
connection therewith. Nothing in this section shall be
construed to permit a warrantless search of a single -
family res i dence, unless the owner or occupi er of the
dwelling has consented to such a warrantless search.
(b)
No confidential information secured pursuant
to this chapter by any official or employee of the
department wi thin the scope and course of the
official's or employee's employment in the prevention,
control, or abatement of lead shall be disclosed by
the official or employee except as it relates directly
to lead and then only in connection with the
official ' s or employee's official duties and within
the scope and course of the official's or employee's
employment.

DEPARTMENT OF HEALTH
The Amendment and Compilation of Chapter 11-41,
Hawaii Administrative Rules, on the Summary Page dated
January 12, 2023 occurred on January 12, 2023
following a public hearing held on December 13, 2022,
after public notice was given in the Honolulu Star-
Advertiser, The Garden Island, Hawaii Tribune-Herald,
and West Hawaii Today on November 8, 2022 and The Maui
News on November 9, 2022.
The foregoing rulemaking action shall take effect
ten days after filing with the Office of the
Lieutenant Governor.
