This right does not conflict with the member's "consent" to the non-judicial punishment proceedings. The member's consent is merely a waiver of the right to demand trial by court-martial and not an admission of guilt. Upon appeal, the next superior commanding officer may set aside the non-judicial punishment action or may approve or reduce, but not increase, the punishment imposed by the member's commanding officer.
