HAR §12-44-73. Conduct of hearing

(a) The presiding officer of the hearing shall convene the hearing, briefly state the nature of the case, and make a determination as to which party has the burden of proof. The determimation shall be made in accordance with section 91-10, HRS. Except as otherwise provided by law, the party initiating the proceeding shall have the burden of proof, including the burden of producing evidence and the burden of persuasion.
