HAR §15-150-32. Penalties

(a) Any person who violates subchapter 2 or 3 shall be l i able as follows: (1) For a c ivil fine not to exceed $100 , 000; or (2) For the cost of returning the affected env ironment or ecol ogy within t he coastal management area t o the condition exi sting before the violation . (b) In addition to any other penal ties , any per son who violates subchapt er 2 or 3 shall be liable for a civil fine not to exceed $10 , 000 a day for each day the violation occur red or persists. (c) Any civil fine or other penal ty provided unde r t his chapter may be imposed by the circuit court or may be imposed by the lead agency after an opportunity for a hearing as provided in t his subchapter . Imposition of a fine shal l not be a 150-26 §15-150-34 prerequisite to any civil fine or other injunctive relief ordered by the circuit court .
